Eluravia is an online retailer offering beauty, cosmetic, skincare, personal-care, beauty accessories, tools, and related products that may change from time to time.

Products may be offered directly by us, manufactured or supplied by third-party manufacturers or suppliers, or fulfilled using third-party logistics providers.

Certain products, features, promotions, payment methods, shipping methods, or Services may not be available in every country or region.

7. PRODUCT AVAILABILITY

All products are subject to availability.

Placing a product in your shopping cart does not reserve inventory.

A product may become unavailable before your order is accepted or fulfilled.

We may establish reasonable purchase limits per customer, household, payment method, address, account, product, promotion, or order.

We may also restrict the sale or delivery of certain products to particular countries or regions because of legal, regulatory, carrier, customs, safety, or logistical restrictions.

8. PRICES AND CURRENCY

Product prices are displayed on the Site in the currency shown for your selected country, region, or storefront.

Prices may change without prior notice before an order is submitted.

10. ORDERS AND CONTRACT FORMATION

An order confirmation email acknowledges that we have received your order. It does not necessarily mean that we have accepted the order.

A binding sales contract is formed when we accept your order, normally when:

Payments may be processed by Shopify and/or independent third-party payment processors.

We generally do not directly store complete payment-card numbers when payments are handled through third-party payment processors.

Payment authorization does not guarantee acceptance of an order.

If payment cannot be authorized, verified, or collected, we may suspend processing or cancel the applicable order.

Delivery dates are estimates unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including:

• Carrier delays;

• Weather;

• Natural disasters;

• Public holidays;

• Remote-area delivery;

• Transportation interruptions;

• Labor disruptions;

• Government actions;

• Import inspections;

• Incorrect or incomplete addresses; or

You are responsible for providing a complete and accurate delivery address.

Where permitted by law, additional costs resulting from an incorrect address, refused package, failed delivery caused by the recipient, or unclaimed parcel may be charged to the customer or deducted from any refund.

Nothing in this section limits rights relating to delayed or non-delivery that cannot be waived under applicable consumer law.

15. RISK OF LOSS AND TITLE

Risk of loss or damage to products passes to you at the time determined by applicable law.

Where mandatory consumer law provides that risk remains with the seller until you, or a person designated by you, physically receives the goods, that rule will apply.

Where permitted by law, title to products passes after full payment has been received and the products have been delivered or otherwise transferred to you.

16. DAMAGED, DEFECTIVE, INCORRECT OR MISSING PRODUCTS

Please inspect your order as soon as reasonably possible after delivery.

If your order arrives:

• Damaged;

• Defective;

• Incorrect;

• Incomplete;

• Materially different from its description; or

• Otherwise affected by a fulfillment problem,

please contact support@eluravia.com promptly and provide your order number and reasonable supporting information.

We may request photographs or other evidence reasonably necessary to assess the issue.

Where your claim is valid, we may provide an appropriate remedy in accordance with our Return & Refund Policy and applicable law, which may include replacement, reshipment, refund, repair where applicable, or another legally required remedy.

17. RETURNS AND REFUNDS

Purchases made directly through www.eluravia.com are subject to our Return & Refund Policy.

Unless otherwise stated in that Policy or required by applicable law, eligible products may generally be submitted for return within 30 days after delivery.

Because we sell beauty, cosmetic, skincare, personal-care, and other hygiene-sensitive products, voluntary returns may be restricted where a product has been:

• Opened;

• Used;

• Tested;

• Sampled;

• Swatched;

• Unsealed;

• Applied to the skin, lips, eyes, hair, or body;

• Contaminated;

• Altered; or

• Removed from hygiene-protective or tamper-evident packaging.

Such restrictions do not limit any mandatory rights you may have where a product is defective, damaged, unsafe, incorrectly supplied, materially not as described, or otherwise covered by applicable consumer-protection law.

The Return & Refund Policy forms part of these Terms.

Where these Terms and the Return & Refund Policy conflict regarding a specific return procedure, the Return & Refund Policy will generally control, subject always to mandatory law.

18. CANCELLATIONS, SUBSCRIPTIONS AND PRE-ORDERS

Where subscriptions, pre-orders, recurring purchases, or similar purchasing options are offered, additional terms displayed during checkout or in our Cancellation Policy may apply.

Subscriptions

If you enroll in a recurring subscription:

• The delivery frequency and subscription price will be shown at checkout;

• Your selected payment method may be charged automatically at each renewal or delivery interval;

• Subscription pricing may be subject to disclosed changes;

• You may manage or cancel your subscription using the method provided in your account, confirmation email, subscription-management portal, or customer support channel; and

• Cancellation generally affects future charges and does not automatically cancel an order that has already entered fulfillment.

Any legally required renewal notices, cancellation rights, or consent requirements will apply.

Pre-Orders

Products identified as pre-orders may not be immediately available.

Estimated availability or shipment dates are estimates and may change.

Where payment or a deposit is collected in advance, applicable cancellation and refund rights will be handled in accordance with the terms disclosed at purchase and applicable law.

19. PROMOTIONS, DISCOUNT CODES AND OFFERS

From time to time, we may offer promotions, discount codes, bundles, gifts, free shipping, loyalty benefits, or other special offers.

Gift cards and store credits:

• Must not be obtained or used through fraudulent activity; and

• May be cancelled where they were issued or acquired as a result of fraud, unauthorized payment, chargeback abuse, or system error, to the extent permitted by law.

Any expiration rules will comply with applicable law.

21. REVIEWS, COMMENTS AND USER CONTENT

The Site may allow you to submit reviews, photographs, comments, feedback, questions, testimonials, or other content (“User Content”).

You retain ownership of intellectual property rights you hold in your User Content.

By submitting User Content to Eluravia, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, translate, distribute, display, and communicate that User Content for purposes connected with operating, improving, marketing, and promoting Eluravia and our Services, to the extent permitted by law.

You represent that:

• You own or have permission to submit the User Content;

• Your User Content is truthful based on your genuine experience where it is presented as a review;

• Your User Content does not violate another person's intellectual property, privacy, publicity, or other rights;

• Your User Content is not unlawful, fraudulent, defamatory, threatening, obscene, discriminatory, or abusive; and

• Your User Content does not contain malicious code, spam, or unauthorized advertising.

We may moderate, reject, or remove User Content where reasonably necessary to enforce these Terms or comply with law.

We will not knowingly condition publication of genuine customer reviews on whether the review is positive or negative where such conduct is prohibited by applicable law.

22. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Site and its contents—including the Eluravia name, logos, branding, graphics, photographs, product presentations, text, page layouts, icons, videos, designs, software, and other materials—are owned by, licensed to, or lawfully used by Eluravia and are protected by applicable intellectual property laws.

You are granted a limited, personal, revocable, non-exclusive, and non-transferable right to access and use the Site for lawful personal shopping and informational purposes.

Without our prior written permission, you may not:

• Copy or reproduce substantial portions of the Site;

• Republish or commercially exploit Site content;

• Modify or create unauthorized derivative works;

• Remove copyright, trademark, or proprietary notices;

• Use Eluravia trademarks in a way likely to cause confusion;

• Scrape or systematically extract Site content for commercial purposes; or

• Misrepresent an affiliation, sponsorship, or endorsement by Eluravia.

Nothing in these Terms transfers ownership of our intellectual property to you.

• To violate intellectual property or other rights;

• To distribute viruses, malware, malicious scripts, or harmful code;

• To scrape, crawl, harvest, or extract data through automated means in violation of applicable law or our instructions;

• To collect another person's personal information without authorization;

• To conduct payment fraud, chargeback fraud, or promotional abuse;

• To place orders using stolen or unauthorized payment credentials;

• To impersonate another person;

• To submit knowingly false or misleading reviews;

• To send spam or unauthorized commercial communications;

• To circumvent product, regional, account, or purchase restrictions; or

25. SHOPIFY

Our online store is hosted using technology provided by Shopify.

Shopify provides the e-commerce infrastructure that enables us to offer the Site and certain Services.

Your use of features provided directly by Shopify may also be subject to Shopify's applicable terms and privacy practices.

Shenzhen Ciweitong Trading Co., Ltd. remains the merchant operating Eluravia unless otherwise clearly stated during a specific transaction.

26. PRIVACY AND PERSONAL INFORMATION

Our collection, use, disclosure, and handling of personal information is described in our Privacy Policy.

By using the Services, you acknowledge that your personal information may be processed as described in that Privacy Policy and in accordance with applicable data-protection laws.

The Privacy Policy forms part of the policies governing your use of Eluravia.

27. MARKETING COMMUNICATIONS

Where permitted by law and where you have provided any required consent, we may send you promotional emails, offers, product updates, or other marketing communications.

You may unsubscribe from marketing emails using the unsubscribe mechanism provided in those messages.

Unsubscribing from marketing communications does not prevent us from sending transactional or service-related communications, such as:

• Order confirmations;

• Shipping notifications;

• Account security messages;

• Refund notices; or

• Important legal or service information.

28. ELECTRONIC COMMUNICATIONS

To the fullest extent permitted by law, Eluravia and Shenzhen Ciweitong Trading Co., Ltd. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of the Site or Services where such exclusion is lawful.

This may include loss of profits, revenue, opportunity, goodwill, or data where those losses were not reasonably foreseeable and where the exclusion is permitted by applicable law.

For claims arising from a particular purchase and where limitation is permitted by law, our aggregate liability will not exceed the greater of:

1. The amount you paid to us for the product or order giving rise to the claim; or

2. Any minimum amount of liability required by applicable law.

These limitations do not affect remedies or protections that cannot lawfully be waived or limited.

32. INDEMNIFICATION

To the extent permitted by applicable law, if you use the Services for commercial purposes or engage in unlawful or unauthorized activity, you agree to indemnify Shenzhen Ciweitong Trading Co., Ltd. and its affiliates, officers, employees, contractors, and service providers against third-party claims, liabilities, damages, losses, and reasonable costs arising directly from:

• Your unlawful use of the Services;

• Your infringement of another person's rights; or

• Fraudulent or intentionally harmful conduct by you.

This provision does not require an individual consumer to indemnify us where such an obligation would be unfair, prohibited, or unenforceable under applicable consumer law.

To the extent permitted by law, we are not responsible for a delay or failure to perform caused by circumstances beyond our reasonable control.

Termination will not affect rights and obligations that arose before termination.

These Terms and transactions with Eluravia are generally governed by the laws of the People's Republic of China, without regard to principles of conflict of laws, except to the extent another law must apply under mandatory legal rules.

If you are a consumer residing in a country or region whose laws provide mandatory consumer protections that cannot be waived by contract, nothing in these Terms deprives you of those protections.

For example, mandatory rights relating to product conformity, refunds, statutory warranties, unfair contract terms, privacy, distance selling, withdrawal rights, or access to local remedies will continue to apply where legally required.

36. DISPUTE RESOLUTION

If a dispute arises in connection with the Site, an order, a product, or these Terms, we encourage you to contact us first at:

Please provide your order number, a description of the issue, and the resolution you are seeking.

We will make reasonable efforts to resolve eligible customer-service disputes directly.

If a dispute cannot be resolved informally, then, subject to any mandatory consumer-protection, jurisdiction, or venue rights available to you, disputes may be submitted to a court of competent jurisdiction in Shenzhen, Guangdong Province, People's Republic of China.

Nothing in this section prevents a consumer from bringing a claim before another court, tribunal, regulator, alternative dispute-resolution body, or similar authority where applicable law gives the consumer a non-waivable right to do so.

37. YOUR MANDATORY CONSUMER RIGHTS

Eluravia sells to customers in multiple countries and regions.

Consumer-protection laws differ between jurisdictions.
